There can be differences in the definition of prostitution from city to city and state to state. The Colorado Revised Statute §18-7-201 outlines what actions constitute a sexual act. According to this section of the law, the sexual act itself does not even have to be performed in order for a person to be charged with prostitution.

Another charge that usually goes hand in hand with prostitution is solicitation. Solicitation involves asking or directing another to commit an act of prosecution, and is punishable by fines and/or jail time. Penalties for Prostitution

Prostitution is usually a Class 3 misdemeanor charge carrying a $50 to $750 fine and a possible 6 month jail sentence for the first offense.
