Driving While Your License is Suspended or Revoked
If your license was under restraint for a
DUI conviction, for a first DUR offense you can be fined up to $1,000. You
can also be incarcerated in the County jail up to 1 year or can have both
penalties enforced and conviction will count as a habitual offender strike
against you. Minimally, you will have to serve 30 days in jail and this
part of the sentence cannot be suspended.
If this is a second DUR for you, the court can fine you up to $3,000 and
put you in jail for a mandatory minimum of 90 days. You can be jailed
for up to 2 years for a second or subsequent conviction and this is a
habitual traffic offender strike. If you are convicted of a second or
more DUR within 5 years of your first conviction, you won't be eligible
for a driver's license in Colorado for 4 years.
There are alternatives to having to serve a jail sentence and the law does
provide for an "emergency" exception to DUR, but we must act
