Vehicular Manslaughter with DUI
Colorado Springs Criminal Defense Attorney
According to the National Highway Traffic Safety Administration's
Fatality Analysis Reporting System drivers and passengers are three times more likely to be killed by an
accident caused by a drunk driver at night rather than during the day.
In El Paso County alone, 44 fatalities occurred from 2005–2009 as
a result of drunk driving accidents. When someone is killed in a car accident,
and one of the drivers is determined to be under the influence of alcohol
at the time, criminal charges of vehicular manslaughter will be filed.
Even if that accident was somehow unavoidable or otherwise not the driver's
fault, prosecutors and judges are extremely harsh on drunk driving cases
where someone lost their life, especially if the defendant had a
blood or breath test that showed their BAC was over the legal limit. If you have been arrested
and charged with vehicular manslaughter while under the influence of alcohol,
you must be aware of the serious penalties at stake for this felony offense.
The Samuelson Law Firm knows how serious vehicular manslaughter charges
can be. Simply being accused of drunk driving can have a profound impact
on your future. When someone has been fatally injured as well, you cannot
afford anything less than the most aggressive defense possible. You future
will be impacted. Minimize the charges against you with a DUI defense lawyer!
Penalties for Vehicular Manslaughter in CO
In a vehicular manslaughter case, the
DUI penalties are much harsher. If convicted, you could be sentenced to the following
penalties for a Class 3 felony:
1. Probation with a possible jail sentence as a condition of probation
of up to 90 days
2. Four to twelve years in the Department of Corrections
3. Up to 24 years in the Department of Corrections if the court finds the
presence of exceptional circumstances
Many police officers, judges, and prosecutors will ignore the facts of
the case and only focus on the fact that this is a
DUI. This is not fair to you. You deserve to have a fair case that takes into
account all of the factors that contributed to the accident. A part of
your vehicle malfunctioning, weather and road conditions can all contribute
to an accident that may have occurred whether or not anyone was drinking.
When you
contact The Samuelson Law Firm, I can provide you with the legal counsel and representation you need
to devise the best defense possible for you. By investigating your accident
and the evidence brought against you, we can hopefully minimize the penalties
and damages to your life and reputation that will come with a conviction.
It is my hope to have every client found innocent, or at the very least,
to have the charges reduced.
