Penalties for Illegal Marijuana Cultivation
Under current Colorado law, anyone cultivating over six marijuana plants for their own personal use or for marijuana plants to be grown on property that they control may find themselves facing criminal charges. Amendment 64 also prohibits anyone under the age of 21 from cultivating marijuana.

- Under six plants: Between six and 18 months in jail and up to $5,000 in fines if the accused is under 21 or cultivating for more than their personal use.
- Between seven and 29 plants: One to three years in prison and up to $100,000 in fines.
- Over 30 plants: Two to six years in prison and up to $500,000 in fines.
- Second cultivation offense: Four and 12 years in prison and up to $750,000 in fines.
