Colorado Springs BUI Attorney

What Does Boating Under the Influence (BUI) Mean?

Boating under the influence refers to the act of being in control of a boat or other water-operated vessel while under the influence. It is a misdemeanor crime to operate or be in actual physical control of a vessel while under the influence of drugs, alcohol or controlled substances. Changes in Colorado law on BUI have gotten rid of the limitation of this offense to only motor boats and sailboats and have extended it to any vessel including canoes, rafts, jet skis and others. Additionally, the blood alcohol content (BAC) of a person considered to be operating under the influence was reduced from .10% to .08%, making the law tougher on boaters.

If you are charged with a BUI offense, you are best served with being represented by a proven Colorado Springs DUI lawyer who is intimately familiar with successful methods of defending alcohol or drug related charges. As the founder of The Samuelson Law Firm, I have spent the past 15 years assisting those who face many types of DUI charges including first time, underage and multiple DUI plus DUI with injury. As in many professions, experience counts and you don't want the protection of your rights and freedoms in the hands of an experienced lawyer.

Common Penalties For BUI

Boating while intoxicated is frequently considered more dangerous than DUI, thus law enforcement and prosecutors will be determined to convict those found in violation of BUI laws. Failure to wear life jackets, the relatively uncontrolled conditions and circumstances of a marine environment and the lessened ability of a boat to break or be maneuvered can all make for unsafe situations. Legal penalties can include, therefore, community service, stiff fines, restitution to any injured persons, mandatory alcohol awareness classes, probation and jail time.

Common penalties for BUI include:

  • Five days to one year in jail
  • Up to $1,000 in fines
  • Up to 96 hours of community service

Unlike a DUI case, however, your driver's license is not threatened by a BUI arrest. What you may lose, however, is the right to be on the water or operate a water vessel for up to one year following the arrest. Colorado is a wonderful place to spend the summers, and part of this is due to the beautiful lakes and reservoirs in the area. Don't put your ability to enjoy the natural beauty at risk by not obtaining proper representation in your BUI case!

Put The Samuelson Law Firm To Work For You

In operating a vessel, you are considered to have given expressed consent to submitting to breath and blood tests if required by the arresting officer. If you refuse to take one of these tests, this can be used against you in a criminal trial. From the moment you are arrested, it will greatly help to have an experienced attorney by your side. My independent investigation into the incident, what occurred and the evidence against you may reveal weaknesses in the prosecution's case that can be aggressively used in your defense.
