When your driving privileges are under "restraint," it means that your license has either been suspended or revoked or your application has been denied. Driving under restraint (DUR) can be alcohol or drug related or not and all the prosecution needs to prove is that you were driving on a public road or highway in Colorado, that your license or privilege to drive was under restraint and that you had knowledge of this fact.

Driving While Your License is Suspended or Revoked
If your license was under restraint for a DUI conviction, for a first DUR offense you can be fined up to $1,000. You can also be incarcerated in the County jail up to 1 year or can have both penalties enforced and conviction will count as a habitual offender strike against you. Minimally, you will have to serve 30 days in jail and this part of the sentence cannot be suspended.
If this is a second DUR for you, the court can fine you up to $3,000 and put you in jail for a mandatory minimum of 90 days. You can be jailed for up to 2 years for a second or subsequent conviction and this is a habitual traffic offender strike. If you are convicted of a second or more DUR within 5 years of your first conviction, you won't be eligible for a driver's license in Colorado for 4 years.
There are alternatives to having to serve a jail sentence and the law does provide for an "emergency" exception to DUR, but we must act now to preserve your rights.
